Fashion with Benefits ("Fashion with Benefits", "we", "us", or "our") is a brand owned and operated by Creative Handicrafts, registered under Societies registration Act. No. Bom/101/1994 GBBSD and Bombay Public Trust Act. No. F-16562 (Bom.) ("Creative Handicrafts" or the "Company"). Fashion with Benefits is a brand name used by the Company for the sale of apparel and related products through this Website, and is not a separately registered legal entity. All references to "we", "us", or "our" in these Terms refer to Creative Handicrafts, operating for the Fashion with Benefits brand.

2. Eligibility

By using this Website, you represent that you are at least 18 years of age, or are accessing the Website under the supervision of a parent or legal guardian, and that you have the legal capacity to enter into a binding contract.

3. Account Registration

You may be required to create an account to place an order. You agree to provide accurate, current, and comprehensive information and to keep this information updated. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Please notify us immediately of any unauthorised use of your account.

4. Products, Pricing & Availability

  • All products are subject to availability. We reserve the right to discontinue, limit quantities of, or modify any product without prior notice.
  • Prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.
  • We make reasonable efforts to display product colours and details accurately; however, we do not guarantee that images displayed on your device will be perfectly accurate due to variations in screens and photography.
  • In the event of a pricing or listing error, we reserve the right to cancel the affected order and issue a full refund, and will notify you of such cancellation.

5. Orders & Acceptance

Placing an order constitutes an offer to purchase a product. An order confirmation email/message merely acknowledges receipt of your order and does not constitute acceptance. A contract for sale is formed only when we confirm dispatch of the product(s). We reserve the right, at our sole discretion, to accept, refuse, or cancel any order for reasons including but not limited to product unavailability, errors in pricing or description, or suspected fraudulent or unauthorised transactions.

6. Payments

All orders on this Website must be paid for in full at the time of placing the order (prepaid orders only). We do not currently offer Cash on Delivery. Payments are processed through third-party, PCI-DSS compliant payment gateway(s). We do not store your card, net-banking, or UPI credentials on our servers; such information is handled directly by our payment partner(s) in accordance with their own security standards and policies.

7. Shipping & Returns

Shipping timelines and charges are governed by our Shipping Policy, and product returns, exchanges and refunds are governed by our Returns & Refunds Policy, both of which form part of, and are to be read together with, these Terms of Use.

8. Intellectual Property

The Website and all content on it — including the Fashion with Benefits name and logo, text, graphics, product images, designs, and software — is the property of Creative Handicrafts and/or its licensors, and is protected by applicable intellectual property laws. No content from this Website may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way without our prior written permission.

9. User Conduct

You agree not to:

  • Use the Website for any unlawful purpose or in violation of these Terms;

Our aggregate liability for any claim arising out of these Terms or your purchase shall not exceed the amount paid by you for the relevant order. Nothing in these Terms shall be construed to limit any liability that cannot be excluded or limited under applicable Indian law, including the Consumer Protection Act, 2019.

You agree to indemnify and hold harmless Creative Handicrafts, its officers, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of your breach of these Terms or your misuse of the Website.

We shall not be held responsible for any delay or failure to perform our obligations under these Terms if such delay or failure arises from causes beyond our reasonable control, including but not limited to natural disasters, strikes, transportation disruptions, government restrictions, or other events of force majeure.

15. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Subject to applicable consumer protection law (which may allow you to approach a consumer forum at your place of residence), the courts at Mumbai, Maharashtra shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms.
